These Terms of Service (“Terms”) govern your access to and use of thedoublescoop.com and pages operated by KB Stores LLC, doing business as The Double Scoop (“The Double Scoop,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and legally able to enter a binding agreement to use the Site. The Site is intended for users located in the United States.

2. Informational and advertising service

The Double Scoop is an advertising-supported publisher. Our content is for general informational and educational purposes only and is not individualized financial, investment, tax, legal, credit, or insurance advice. We are not a lender, bank, loan broker, insurance company, insurance producer, credit-repair organization, financial adviser, or agent or representative of you.

Nothing on the Site is an offer, approval, commitment to lend, guarantee of credit, insurance quote, or promise of savings. You should independently evaluate any product and consult a qualified professional when appropriate.

3. Affiliate and advertising disclosure

We may receive compensation when you view, click, submit information through, or obtain a product from an advertiser or partner linked from the Site. Compensation may affect which products we feature and their placement. Not every available company, product, or offer is included. Sponsored or compensated content does not change your price unless the provider expressly states otherwise.

4. Rates, savings, reviews, and eligibility

Consent to marketing is not a condition of using this Site.

You may not interfere with Site operation or security; introduce malicious code; scrape, copy, frame, or republish Site content at scale; impersonate another person; submit false information; violate another party’s rights; or use the Site in violation of law. We may restrict or terminate access for suspected misuse.

8. Intellectual property

The Site and its text, design, graphics, logos, illustrations, software, and other content are owned by or licensed to KB Stores LLC and are protected by intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access the Site for personal use. No other rights are granted.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED AVAILABILITY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KB STORES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES; OR DAMAGES ARISING FROM THIRD-PARTY PRODUCTS, COMMUNICATIONS, DECISIONS, OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US, IF ANY, TO USE THE SITE DURING THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless KB Stores LLC and its members, managers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys’ fees, arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another party’s rights.

12. Disputes, governing law, and venue

These Terms are governed by Florida law, without regard to conflict-of-law principles. Before filing a claim, you and KB Stores LLC agree to send written notice describing the dispute and requested relief and to attempt in good faith to resolve it for 30 days. Unless applicable law requires otherwise, any lawsuit arising from the Site or these Terms must be brought exclusively in the state or federal courts serving Pinellas County, Florida, and each party consents to their jurisdiction and venue. You and KB Stores LLC waive any right to a jury trial to the extent permitted by law. Claims must be brought individually and not as a plaintiff or class member in a class, consolidated, or representative action, to the extent permitted by law.

13. Changes, severability, and entire agreement

We may update the Site and these Terms. Updated Terms take effect when posted unless otherwise stated. If a provision is found unenforceable, it will be enforced to the maximum permissible extent and the remaining provisions will remain effective. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site. Our failure to enforce a provision is not a waiver.
